1a. The following types of uses of our services are forbidden and classified as abuse.
1aa. Any activity, intentional or otherwise, that consumes sufficient system resources to negatively affect other clients or equipment.
1ab. Any email-based communications sent without the consent of the recepient.
1ac. Knowingly permitting or initiating Unsolicited Communications is grounds for immediate termination, and a permanent ban from any future service.
1ad. Any type of script, code, or other file that performs harmful action, either to the user affected or as a bulk action triggered by the user.
1ae. Any content that violates the laws of the country it resides in, including any content that violates the laws of the states of New Jersey, New York, Florida, or the laws of the United States of America.
1af. Knowingly permitting or hosting Malicious Content is grounds for immediate termination, and a permanent ban from any future service.
1ag. We have a zero-tolerance policy for adult content. This includes but is not limited to any content which is sexually explicit, sexually suggestive, or pornographic in nature is forbidden and will result in an automatic termination of the user's account.
1b. Punishment for intentional/malicious abuse.
1ba. Intentional / Malicious usage is defined as any action knowingly performed by the user, or persons user has authorized to access the service, that is categorized in the above Abuse Definitions.
1bb. All services on the user's account will immediately be terminated without compensation, save for situations where a court order demands evidence be turned over to law enforcement.
1bc. The user will be permanently banned from holding any further service with PeaHost.com, Sunshine Tech and Media, LLC and/or any other related companies.
1c. Order of Execution During Abuse Offenses
1ca. The offending service will be brought offline, and left in a suspended state.
1cb. A support ticket will be opened to the service owner detailing the offense and the necessary steps required to resolve the situation.
1cc. Once the service owner replies to the ticket acknowledging that they understand the issue and how to correct the problem, the service will be reactivated and the service owner will have 24 hours to prevent any further abuse.
1cd. Failure to address abuse cases will result in your services being suspended, and in extreme cases, terminated.
2a. By using our services, you accept our Acceptable Use policy and our Terms of Service.
2b. We reserve the right to suspend or deny services according to our individual judgement.
3a. Clients must provide their legitimate first and last name, and residential address OR physical and exclusive commercial address if the client submits a company name belonging to or employing the client under the 'company name' field. P.O. boxes, virtual addresses, forwarding addresses, etc. are not allowed. The listed information must match that of the payment method used. Registration and use must take place from the client's IP address.
4a. Accounts are billed automatically - unless otherwise specified - at every interval between billing cycles. Clients may request a full refund within 30 days of initial purchase, unless the account is terminated due to violation of our terms of service or acceptable use policy. Prices may increase. Account credit may not be transferred or withdrawn and will not expire unless the account is terminated for violation of our terms of service or acceptable use policy.
4b. Unpaid services may be suspended and/or terminated for non-payment.
5a. Chargebacks and/or disputes will result in an immediate suspension of all services and termination of the user's account without compensation, regardless of whether or not the dispute or chargeback is completed fully.
6a. This terms of service and acceptable use agreement may be modified in the future. Notification will be sent out upon these changes taking place.
7a. PeaHost.com, Sunshine Tech and Media LLC, and related companies, and/or employed, company owners/operators/officers, or contracted individuals of said or related entities will not be held liable for any content hosted on its platform.
7b. PeaHost.com, Sunshine Tech and Media LLC, and related companies, and/or employed, company owners/operators/officers, or contracted individuals of said or related entities will not be held liable for any data loss which may involuntarily be experienced, or which is experienced due to violation of this Acceptable Use policy and Terms of Service.
8a. PeaHost.com and all related individuals or entities are forbidden from purposefully revealing private or sensitive client information to the public. This includes but is not limited to credit/debit card information, phone numbers, age, names, physical addresses, email addresses, and any description of location, appearance, or other identifying factors other than those which are so vague that they couldn't reveal the client's identity or other sensitive information.
